Eligibility

With a few exceptions, to be eligible to use the types of leave covered in this policy, a UT Permian Basin employee must be appointed to work at least 20 hours per week for a continuous period of at least four and one-half months and not working in a position that requires student status as a condition of employment. Faculty on a 9-month appointment may not be eligible for all categories of leave covered by this policy. Employees do not need to meet these requirements for jury service or to serve as a witness, to comply with a subpoena, or, if a peace officer, for legislative leave. Different eligibility standards apply to the Family and Medical Leave Act (“FMLA”) and Fair Labor Standards Act (“FLSA”) overtime. FMLA eligibility standards are detailed in the respective section in this policy. FLSA overtime is covered in UTPB’s FLSA Overtime and State Compensatory Policy HOP Section III, 3, 1.
